Compensatory Time (Comp Time)

Under the State’s overtime compensation policy, all employees who are non-exempt from the Fair Labor Standard Act (FLSA) are eligible for compensatory time in lieu of overtime pay.

Employees whose duties and responsibilities have been determined by Human Resources to be “subject” to the provisions of FLSA are considered “Non-Exempt” employees. These employees must track their work time by clocking in and out each day.  Non-Exempt employees accrue leave at time and one half for each hour worked over 40 in a workweek.

Full-time and part-time (20 hours or more) permanent, probationary, and time-limited employees are eligible for compensatory time. Temporary and part-time (less than 20 hours) employees are not eligible for compensatory time.

Overtime compensatory time shall be taken before any vacation or bonus leave and within twelve months from the date the work is performed. Compensatory time is not cumulative beyond a twelve-month period and may not be transferred to another agency.
